Terms & Conditions

Last updated: 17 March 2026

These Terms and Conditions apply to the sale of condiments and related products through the website and brand known as The Sauce Foundry. By placing an order, you agree to be bound by these Terms and Conditions.

1. About Us

The Sauce Foundry is a trading brand used by Chilli Pete.

Registered trading name: Chilli Pete
Registered trading address: 16 Lambourn Court, Emerson Valley, Milton Keynes, MK4 2DA, United Kingdom

The Sauce Foundry brand name is not a registered trade mark. All sales are made by Chilli Pete.

2. Application of These Terms

These Terms and Conditions apply to all orders placed by consumers through our website for the purchase of condiments and related products.

Please read these Terms carefully before placing an order. If you do not agree to them, you should not place an order.

3. Products

We take reasonable care to ensure that product descriptions, ingredients, pricing and images are as accurate as possible. However, because our products are food items and may be made in small batches, there may be slight variations in colour, texture, consistency and heat level from one batch to another.

Product images are for illustrative purposes only. The actual product and packaging may vary slightly from what is shown on the website.

4. Food Information and Allergens

Customers are responsible for checking product ingredients, allergen information and any other product information before consuming our products.

We aim to provide accurate ingredient and allergen information on our product labels and website. Prepacked food must carry an ingredients list, and allergenic ingredients must be emphasised in that list under UK food labelling rules. Please always refer to the product label supplied with the item as the primary source of information. :contentReference[oaicite:0]{index=0}

If you have any allergy, intolerance, medical condition or dietary concern, please do not consume a product unless you are satisfied that it is suitable for you.

5. Eligibility to Purchase

By placing an order through our website, you confirm that:

  • you are legally capable of entering into a binding contract; and
  • the information you provide is accurate and complete.

6. Orders

All orders are subject to acceptance and availability.

After placing an order, you will usually receive an order confirmation email. This email is only an acknowledgement that we have received your order and does not mean that your order has been accepted.

A contract between you and Chilli Pete will only be formed when we accept your order and dispatch the goods.

We reserve the right to refuse or cancel any order, including where:

  • the product is unavailable;
  • there has been an error in the price or description;
  • we suspect fraud, misuse or unauthorised activity; or
  • we are otherwise unable to fulfil the order.

If we cancel an order after payment has been taken, we will refund the amount paid.

7. Prices and Payment

All prices are shown in pounds sterling (£).

Chilli Pete is not VAT registered, so VAT is not charged on orders.

Prices may be changed at any time before you place an order. The price payable for your order will be the price shown on the website at the time you submit it.

You must also pay any applicable delivery charges shown at checkout. Under UK distance selling rules, traders must make the total price and any delivery charges clear before the order is placed. :contentReference[oaicite:1]{index=1}

Payment must be made in full at the time of ordering using one of the payment methods made available on the website.

8. Delivery

We use Royal Mail to deliver orders.

Delivery charges are calculated at checkout based on the order weight and the delivery service selected.

Any delivery dates or timeframes stated on the website or in communications are estimates only and are not guaranteed.

We are not responsible for delays caused by Royal Mail, events outside our control, or inaccurate delivery details supplied by the customer.

Risk in the goods passes to you on delivery. Ownership of the goods passes to you once we have received payment in full.

9. If You Need to Report a Problem

If your order arrives damaged, defective, incorrect or incomplete, please contact us as soon as reasonably possible and, where possible, within 48 hours of delivery.

We may ask for photographs and further information to help us investigate the issue.

Nothing in these Terms affects your statutory rights. Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. :contentReference[oaicite:2]{index=2}

10. Cancellation Rights and Returns

If you are a consumer purchasing online, you generally have the right to cancel your order within 14 days after receiving the goods under the Consumer Contracts Regulations. If you cancel within that period, you then have a further 14 days to send the goods back. :contentReference[oaicite:3]{index=3}

However, this cancellation right does not apply in every case. In particular, the right to cancel can be lost for sealed goods which are not suitable for return for health protection or hygiene reasons if they become unsealed after delivery, and may not apply to perishable food items depending on the nature of the goods. :contentReference[oaicite:4]{index=4}

Because our products are food items, we do not accept returns of any opened, used or unsealed products unless they are faulty, damaged, unsafe or not as described.

If you wish to cancel an order that is eligible for cancellation, you must notify us in writing within the applicable cancellation period. Returned items must be sent back in a resaleable condition where cancellation rights apply.

Unless the goods are faulty or incorrect, you are responsible for the cost of returning the goods.

Refunds due will be made within 14 days of receiving the returned goods back, or within 14 days of receiving evidence that they have been sent back, whichever is earlier where applicable. :contentReference[oaicite:5]{index=5}

11. Consumer Rights for Faulty or Misdescribed Goods

Nothing in these Terms excludes or limits any rights you have under applicable consumer law.

If goods are faulty, unsafe, not as described, or otherwise do not conform to the contract, you may be entitled to a repair, replacement, price reduction or refund in accordance with your statutory rights. :contentReference[oaicite:6]{index=6}

12. Product Use and Safety

Our condiments are intended for normal culinary use only.

Some products may contain chilli or other ingredients that some individuals may find very hot or irritating. You are responsible for using and consuming our products sensibly and in accordance with any instructions or warnings provided.

We are not liable for issues arising from misuse, overconsumption, failure to check ingredients, or use contrary to any product guidance.

Products should be stored in accordance with any storage instructions shown on the label or packaging.

13. Website Content

We try to ensure that all information on our website is accurate and up to date, but we do not guarantee that the website will always be error-free, uninterrupted or free from inaccuracies.

We may update, withdraw or change products, pricing, descriptions, website content or these Terms at any time.

14. Intellectual Property

All content on the website, including text, branding, logos, graphics, photographs and product descriptions, is owned by or licensed to Chilli Pete unless otherwise stated.

You may not copy, reproduce, distribute, modify or use any such content without prior written permission.

15. Our Liability

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation; or
  • any matter for which it would be unlawful to exclude or limit liability.

Subject to the above, we shall not be liable for any indirect or consequential loss.

We are only responsible for losses that are a foreseeable consequence of our breach of these Terms or our failure to use reasonable care and skill.

16. Privacy

Any personal information you provide in connection with an order will be handled in accordance with our Privacy Policy.

17. Events Outside Our Control

We are not responsible for any delay or failure to perform our obligations where that delay or failure results from events beyond our reasonable control, including postal disruption, extreme weather, strikes, supply chain failure, fire, flood, accident or network outages.

18. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the remainder of the Terms shall remain in full force and effect.

19. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of England and Wales.

Any dispute or claim arising out of or in connection with these Terms or any order placed with us shall be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law allows otherwise.
